Art. 2 – Purpose

These Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders

for products on Buonanno. They do not govern the provision of services or the sale of products

by third parties who may appear on the website via links, banners, or other connections.

Before submitting orders or purchasing products or services from third parties, users are advised

to carefully review their respective terms and conditions of sale.

Art. 3 – Conclusion of the Contract

To complete a purchase, users must fill out the electronic order form and follow the relevant on-screen instructions.

The form includes references to these Terms and Conditions of Sale, product images and prices,

accepted payment methods, delivery procedures, shipping costs and times,

as well as information regarding the right of withdrawal and product return policies.

these Terms and Conditions, including information on withdrawal rights and personal data processing.

The contract is considered concluded when Buonanno receives the completed form,

after verifying the accuracy of the data provided.

The buyer is obliged to pay the total price once the online order submission procedure has been completed.

This occurs by clicking the “Place Order” button at the end of the checkout process.

Once the contract has been finalized, Buonanno will process the order in its entirety.

Art. 4 – Registered Users

When completing the registration process, users must follow the instructions provided on the website

and enter accurate and truthful personal information.

Buonanno shall not be held responsible for any incorrect or false information provided by users.

Users agree to promptly notify Buonanno of any changes to their personal details.

If incorrect or incomplete data are provided, or in case of disputes concerning payments,

Buonanno reserves the right to withhold or suspend the service until such issues are resolved.

Upon first registration, Buonanno will assign a username and password to the user.

These credentials constitute the access system for Buonanno’s services and the only valid means

of identifying the user. All actions performed using these credentials shall be considered binding

on the user.

Users are required to keep their access credentials confidential, store them securely,

and not share them with third parties, even temporarily.

Art. 5 – Product Availability

<li>

Product availability refers to the stock at the time an order is placed. This information is indicative only,

as products may be sold to other customers simultaneously before the order is confirmed.

Even after sending an order confirmation email, partial or total unavailability may occur.

In such cases, the order will be automatically adjusted, and the buyer will be informed by email.

If the buyer requests the cancellation of the order, thereby terminating the contract,

Buonanno will refund the amount paid within 30 days of receiving the cancellation notice.

Art. 7 – Prices and Payment Methods

<li>The prices displayed on the website are those valid at the time of order submission, except in the case of obvious errors.</li>

<li>In the event of an error, Buonanno will promptly notify the buyer, allowing them to confirm the order at the correct price or cancel it. Buonanno shall not be obliged to sell any product at an incorrectly lower price.</li>

<li>Prices include VAT but exclude shipping costs. Prices may change at any time, without affecting confirmed orders.</li>

<li>Once the desired products have been added to the cart, the user can follow the checkout instructions, entering or verifying the required information. Order details can be modified before payment.</li>

<li>Payment can be made via: credit or debit cards (VISA, VISA Electron, MasterCard, Postepay, American Express, and Carta Aura), Klarna, and PayPal.</li>

Art. 8 – Delivery

<li>Buonanno ships throughout Italy, excluding Vatican City and the Republic of San Marino.</li>

<li>Deliveries will be made to the address provided by the user at the time of purchase.</li>

<li>For deliveries within Italy, products are generally delivered within 3–4 working days or, if no delivery date is specified, within 30 days from the confirmation of the order.</li>

<li>For EU countries, delivery usually takes up to one week and, in any case, no later than 30 days.</li>

<li>For non-EU destinations, delivery takes approximately 15–20 working days, or in any case within a maximum of 30 days.</li>

<li>If delivery is not possible, the goods will be held in storage, and the user will receive an email indicating where and how to collect or reschedule delivery.</li>

<li>If the user is not present at the delivery address, a new delivery date will be arranged.</li>

<li>If delivery cannot take place for reasons not attributable to Buonanno, the contract will automatically be considered terminated after 30 days.</li>

<li>Following termination, amounts paid (excluding delivery costs) will be refunded within 30 days, less any additional charges arising from the customer’s chosen delivery method.</li>

<li>Shipping costs are borne by the customer and are displayed during checkout.</li>

Art. 9 – Transfer of Risk

<li>The risk passes to the buyer upon delivery. Ownership of the products is transferred once full payment has been received, including shipping costs.</li>

Art. 10 – Warranty and Product Conformity

<li>The seller is responsible for any defects in the products offered, including non-conformity with the items ordered, in accordance with Italian law.</li>

<li>If the buyer is a consumer (a natural person purchasing for non-professional purposes), the warranty is valid for 24 months from the delivery date, provided that the defect is reported within 2 months of discovery and that the return form is correctly completed.</li>

<li>In case of defects, consumers are entitled to have the products repaired or replaced free of charge, or alternatively to receive an appropriate price reduction or refund.</li>

<li>All costs of returning defective products will be covered by the seller.</li>

Art. 11 – Right of Withdrawal

<li>In accordance with current legislation, buyers have the right to withdraw from the purchase without penalty and without providing a reason, within 14 days from receipt of the products, pursuant to Article 57 of Legislative Decree 206/2005.</li>

<li>For multiple purchases made with a single order and delivered separately, the 14-day period starts from the receipt of the last item.</li>

<li>To exercise the right of withdrawal, users may send an email with their order number and name to: <a href="mailto:customercare@buonanno.it">customercare@buonanno.it</a>.</li>

<li>The buyer may also exercise the right of withdrawal by sending any explicit statement of their decision to withdraw from the contract.</li>

<li>Returned goods may be delivered to any Buonanno boutique in Italy or shipped to: Via Alessandro Scarlatti, 178 – 80127 Naples (NA). Return shipping costs are always borne by the customer.</li>

<li>Returned goods must be intact, in their original packaging, and accompanied by all related documentation. After verifying compliance, Buonanno will refund the product amount within 7 days, deducting any additional costs as per Art. 8, paragraph 9.</li>

<li>As per Article 56(3) of Legislative Decree 206/2005 (amended by Legislative Decree 21/2014), the refund may be withheld until the goods have been received or the buyer provides proof of shipment.</li>

<li>The right of withdrawal does not apply to products and services falling under Article 59 of Legislative Decree 206/2005.</li>

<li>Buonanno will issue refunds using the same payment method chosen by the buyer. In the case of bank transfers, buyers must provide their IBAN, SWIFT, and BIC codes.</li>

Art. 12 – Data Processing

<li>Buyer data are processed in compliance with applicable data protection laws, as detailed in the Privacy Policy pursuant to Article 13 of EU Regulation 2016/679 (GDPR).</li>

Art. 13 – Severability Clause

<li>If any provision of these Terms and Conditions is deemed invalid or unenforceable, this shall not affect the validity of the remaining provisions, in accordance with the general principle of contract preservation.</li>

Art. 15 – Governing Law and Jurisdiction

<li>These Terms and Conditions are governed by and interpreted in accordance with Italian law, without prejudice to any mandatory provisions of the consumer’s country of residence.</li>

<li>Any disputes arising from or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Italian courts. For consumers, the competent court shall be that of their place of residence or domicile.</li>
